Zener Engineering Services Limited (ZES), whose registered office is at Rutherford House, Warrington Road, Birchwood, Warrington, WA3 6ZH United Kingdom, are a Specialist Engineering Consultancy Service provider operating in the life science industry.

ZES act as the data controller of personal information obtained from ZES Clients, who have a need for engineering consultancy services and of personal information submitted by Subcontractor Companies and Subcontractor Consultants, who are interested in providing their services on a subcontract or PAYE basis via ZES.

ZES have appointed Director David Easton as Data Protection Officer ("DPO"), who can be contacted via the ‘Contact ZES’ page of the ZES website www.zeneronline.co.uk.

This privacy policy describes how data from ZES Clients, Subcontractor Companies, Subcontractor Consultants and PAYE Consultants (ZES Staff) is obtained, processed, forwarded and what individual parties' rights are in respect of their personal data held by ZES. If these parties have any concerns or questions regarding the processing of personal information, please contact the ZES DPO.

Collecting and Processing Information

The main aim of ZES is to provide engineering consultancy services to life science industry Clients, utilising ZES Staff and Subcontractors Consultants to fulfil ZES Clients’ requirements. In order to provide this service and for ZES to satisfy their legal and business obligations, ZES collect essential required Personal Data (Identity Information) for further processing as necessary:


  • in order to take contract negotiation steps, at the request of the Subcontractor prior to entering into a formal contract
  • in the performance of a contract to which the Subcontractor Company and Subcontractor Consultant subscribe
  • to provide and improve products and services for Clients
  • in operation of Client or Customer accounts
  • for research or archiving purposes
  • to comply with legal requirements
  • for recruitment purposes
  • for dealing with queries, complaints or claims:


In the case of a Subcontractor Company, details such as company name, registered office address, company number, VAT number, telephone numbers, email address and intended consultant CV, are required for contract negotiations. In the case of the Subcontractor Consultant, details such as name, address, telephone numbers and email address are required for contract negotiations.


ZES lawful bases for collecting or using personal information as detailed above are:


  • Consent - ZES have permission from you after we gave you all the relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.
  • Contract - ZES have to collect or use the information so we can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object.
  • Legal obligation - ZES have to collect or use your information so we can comply with the law. All of your data protection rights may apply, except the right to erasure, the right to object and the right to data portability.
  • Legitimate interests - ZES collect or use your information during Contract Negotiations because it benefits you, ZES or a Client, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability.

How ZES Process Data

In order for ZES to be able to negotiate contracts, ZES Staff, Client, Subcontractor Company and Subcontractor Consultant information will be required, retained, processed and disclosed by ZES in the following ways:



  • To facilitate the contract negotiation process with specific Clients who have specific requirements
  • To allow details of ZES Staff and Subcontractor Consultant skills and experience, to be viewed by ZES Clients following consent being provided by the ZES Staff member or Subcontractor Consultant in each case
  • To keep the ZES Staff member or Subcontractor Consultant informed of future opportunities, which ZES think may be of interest to the ZES Staff member or Subcontractor Consultant, via email and telephone
  • To carry out ZES obligations arising from any contracts entered into between the Client, ZES Staff member or Subcontractor Company, Subcontractor Consultant and ZES
  • To carry out ZES obligations arising from any contracts (or contract negotiations) entered into between the ZES Staff member or Subcontractor Company, Subcontractor Consultants and ZES
  • ZES do not use ZES Staff member, Client, Subcontractor Companies and Subcontractor Consultants personal information to make solely automated decisions


As a result, ZES Staff member, Client, Subcontractor Companies and Subcontractor Consultants' information will only be accessible to, and processed by, senior responsible ZES management, if they have a legitimate business need to do so.

 How Does ZES Receive Information About You?

ZES receive your Personal Information from various sources:


  • When you voluntarily provide ZES with your personal details in order to register with ZES;
  • When you use or access our Site in connection with your use of our services;
  • From third-party service providers and public registers.
  • Previous employment or contract.
  • Verbally to a ZES representative

What Information Do ZES Collect?

ZES collect two types of data and information from our website Users.

The first type of Personal information is unidentified and non-identifiable information pertaining to a User(s), which may be made available or gathered via your use of the Site (“Non-personal Information”). ZES are not aware of the identity of a User from which the Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time, etc.) in order to enhance the functionality of our Site. ZES want its Staff members, Clients, Subcontractor Companies and Subcontractor Consultants to be in control of how their personal information is used. If a ZES Staff member, Client, Subcontractor Company or Subcontractor Consultant wishes to inform ZES of any changes to their personal information or wish to correct the personal information ZES hold, they can contact ZES via the 'Contact ZES' page of the ZES website www.zeneronline.co.uk.

In the event that a ZES Staff member, Client, Subcontractor Company or Subcontractor Consultant:

  • Have any queries about the information that ZES holds
  • Wishes to inform ZES of any changes in information or wishes to correct the information ZES hold
  • Have any requests with regard to ZES processing of personal data
  • Wishes to access information held by ZES
  • Does not wish ZES to hold personal information

 

The Client, Subcontractor Company or Subcontractor Consultant is entitled to inform ZES at any time and ZES will remove all such information as specified by the Client, Subcontractor Company or Subcontractor Consultant, from ZES database/systems in accordance with the law.

Please note that these rights are not absolute and may be subject to our own legitimate interests and regulatory requirements.


ZES will endeavour to respond to your request within one month. In certain circumstances ZES may need extra time to consider your request and can take up to an extra two months. If ZES are going to do this, ZES will let you know within one month that it needs more time and why.


ZES may need you to prove your identity. However, ZES will only ask you for just enough information to be sure you are the right person. If ZES require additional information for these identification purposes, then the one-month time period to respond to your request shall begin from when ZES receive this additional information.

ZES act as a service provider and supports ZES Clients, Subcontractor Company and Subcontractor Consultants in the life science industry. Following prior written consent, ZES Staff members, Subcontractor Companies and Subcontractor Consultants personal information will be shared with a specific ZES Client for the purposes of contract negotiations and during contract performance as appropriate.

From time to time, ZES may send Clients, ZES Staff members, Subcontractor Company and Subcontractor Consultants information that ZES perceive may be of interest. ZES send such information via ZES email only.

If at any time, ZES Staff members, Clients, Subcontractor Company and Subcontractor Consultants prefer not to receive further communications from ZES in any form, they have the ability to unsubscribe from such communications by contacting ZES via the 'Contact ZES' page of the ZES website www.zeneronline.co.uk.

ZES do not rent, sell or share ZES Staff members, Clients, Subcontractor Company and Subcontractor Consultants information with third parties, except for legitimate business reasons.

ZES retain ZES Staff member, Client, Subcontractor Company and Subcontractor Consultant personal data for varying time periods in order to assist ZES in complying with legal and regulatory obligations, to enable compliance with any requests made by regulators or other relevant authorities and agencies, to enable ZES to establish, exercise and defend legal rights and claims, and for other legitimate business reasons.

ZES retain ZES Staff member, Client, Subcontractor Company and Subcontractor Consultant personal data for the period of time required for the purposes for which it was collected, any compatible purposes which ZES subsequently establishes, any new purposes to which ZES Staff member, Client, Subcontractor Company and Subcontractor Consultants subsequently consent, or to comply with legal, regulatory and policy requirements.

ZES aim to ensure that all ZES Staff members, Clients, Subcontractor Companies or Subcontractor Consultants, personal information is correct.   • The right to object to processing justified on legitimate ZES business interest grounds. If an objection is received, ZES will stop that processing unless ZES can either demonstrate compelling legitimate grounds for the processing that override the Clients, Subcontractor Companies or Subcontractor Consultants' interests, rights and freedoms or where ZES need to process the data for the establishment, exercise or defence of legal claims. ZES may rely upon legitimate business interests as a basis for information processing and demonstrate compelling legitimate grounds, but ZES will consider each case on an individual basis.
